Please read these Terms of Service ("Terms") carefully before using Oasis SoloGen AI ("the App"), operated by Chisel Theory LLC ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Acceptance of Terms
By accessing or using the App, you confirm that you are at least 17 years of age and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Service
Oasis SoloGen AI is an on-device AI image generation application. After an initial one-time model download, all AI inference (image generation, editing, and language model interaction) runs entirely on your device. The App does not transmit your images, prompts, or generated content to any server.
3. License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control, for personal, non-commercial use.
4. In-App Purchase
The App offers a single non-consumable in-app purchase ("Oasis Unlocked") that provides access to additional features. All purchases are processed through the Apple App Store and are subject to Apple's terms and conditions. Refund requests must be directed to Apple.
5. Use Restrictions
You agree not to use the App, its AI models, or any derivatives of its output:
- In any way that violates any applicable national, federal, state, local, or international law or regulation;
- For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way;
- To generate or disseminate verifiably false information and/or content with the purpose of harming others;
- To generate or disseminate personal identifiable information that can be used to harm an individual;
- To defame, disparage, or otherwise harass others;
- For fully automated decision making that adversely impacts an individual's legal rights or otherwise creates or modifies a binding, enforceable obligation;
- For any use intended to or which has the effect of discriminating against or harming individuals or groups based on online or offline social behavior or known or predicted personal or personality characteristics;
- To exploit any of the vulnerabilities of a specific group of persons based on their age, social, physical, or mental characteristics, in order to materially distort the behavior of a person pertaining to that group in a manner that causes or is likely to cause that person or another person physical or psychological harm;
- For any use intended to or which has the effect of discriminating against individuals or groups based on legally protected characteristics or categories;
- To provide medical advice and medical results interpretation;
- To generate or disseminate information for the purpose to be used for administration of justice, law enforcement, immigration, or asylum processes, such as predicting an individual will commit fraud/crime commitment;
- To generate child sexual abuse material (CSAM) or any sexualized content involving minors;
- To create non-consensual intimate imagery of real individuals;
- To impersonate real individuals for fraudulent or deceptive purposes;
- To generate content intended to facilitate violence, terrorism, or illegal activities.
6. Content Responsibility
You are solely responsible for all content you generate using the App. We do not monitor, review, or store your generated content. You acknowledge that AI-generated images may be imperfect and should not be relied upon as accurate representations of real people, places, or events.
7. Intellectual Property
The App, including its code, design, and user interface, is protected by copyright and other intellectual property laws. The AI models included in the App are licensed under their respective open-source licenses. You retain ownership of content you create using the App, subject to these Terms and applicable third-party model licenses.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.
10. Termination
We reserve the right to terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted within the App and on our website. Your continued use of the App after any changes constitutes acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
